Civilian defenders

In accordance with Federal Law No. 61-FZ “On Defense” dated May 31, 1996, all companies, commercial and non-commercial, regardless of their form of ownership, are required to maintain military records of their employees to ensure the completeness and reliability of data on employees in the reserves and subject to conscription for military service. This process is directly regulated by Decree of the Government of the Russian Federation dated November 27, 2006 No. 719 “On approval of the Regulations on military registration” (as amended on April 16, 2008), as well as by the instructions of the General Staff of the Armed Forces of the Russian Federation, issued in 2007.

Citizens who are not registered with state authorities, local self-government or organizations for the period of mobilization and during wartime or situation are included in the general military register. If the uninterrupted operation of the enterprise depends on the qualifications and position of the employee in the event of mobilization and the onset of war, then he is placed on a special military register. The presence of military registration documents for those liable for military service and persons subject to conscription for military service is mandatory upon conclusion employment contract(Article 65 of the Labor Code of the Russian Federation).

Information about the registration of a new enterprise or about a change in the status of an already registered enterprise is received by the military registration and enlistment office within five working days from the moment it is entered into the Unified State Register of Legal Entities. The registration authority must take care of this. Accordingly, people in uniform will check the company for the correctness of military registration.

In accordance with clause 12 of the Regulations on Military Registration, if an organization has less than 500 citizens on military registration as of December 31 of last year, registration can be kept by one employee performing this work part-time. If there are more people, this should be done by so-called exempt employees, for whom keeping military records will be their only function.

Having counted the people, it is necessary to prepare an order on the organization of military registration at the enterprise and a work plan for maintaining military registration in the company, which will subsequently be agreed upon with the military commissariat. In addition, you should prepare a list of the organization’s employees who are in reserve.

Who must be taken into account? According to clause 14 of the Regulations on Military Registration, this is:

  • male citizens aged 18 to 27 years who are required to be registered with the military and are not in the reserves (conscripts);
  • citizens who are in reserve (those liable for military service).
  • in stock;
  • discharged from military service and enlisted in the reserves of the Armed Forces of the Russian Federation;
  • have successfully completed the training program for reserve officers at military departments of various educational institutions;
  • those who have not completed military service due to exemption from conscription;
  • those who have not completed military service due to deferments from conscription or were not called up for military service for any other reasons before the age of 27;
  • discharged from military service without military registration and subsequently registered with military commissariats;
  • have completed alternative civil service.

Women with military registration specialties are also liable for military service. The list of professions and specialties is defined in the annex to the Regulations on Military Registration. For example, workers who have a diploma as a doctor, signalman, meteorologist, surveyor, etc.

When hiring employees, the personnel officer must check military IDs (temporary certificates issued in place of military IDs) for citizens who are in the reserves, and check the draft certificates for young people, who are dear to us everywhere. If unspecified corrections, inaccuracies, forgeries or an incomplete number of sheets are found in documents, their owner should be sent to the military commissariat at the place of military registration.

And of course, the HR accountant must correctly fill out Section II “Information on military registration” of the employee’s personal card (Form No. T-2) or the personal card of a civil servant (Form No. T-2 GS). These documents must be filled out in clear, legible handwriting, neatly, in ink, ballpoint, gel pens in black or blue, and notes on reconciliation with military registration documents of military commissariats (local government bodies) must be made in pencil. The cards are filled out in two copies, one of which is placed in the employee’s personal file, and the other in the file cabinet of personal cards of citizens registered with the military. Personal cards are stored in a file cabinet in sections: reserve officers; warrant officers, midshipmen, sergeants; foremen, reserve soldiers and sailors; female conscripts; conscripts.

All hired and dismissed citizens in the reserves, and citizens subject to conscription for military service must be reported to the military registration and enlistment office within two weeks. Different military registration and enlistment offices put forward different requirements for the design and content of documents. But in any case, the message must indicate: military rank; surname, first name, patronymic; year of birth; military specialty; family composition; location; date of admission (dismissal). Within two weeks, the military registration and enlistment office should be notified of changes in marital status, education, structural unit organization, position, place of residence or place of temporary stay, health status of employees registered with the military. Every year, in September, lists of male workers aged 15–16 years should be submitted, and before November 1, lists of male workers subject to initial military registration next year.

When monitoring the maintenance of military registration in a company, military registration and enlistment offices check the completeness of coverage of citizens with military registration; the reliability of the data contained in the personal cards of citizens, etc. The results of audits are reflected in the audit logs of military registration and reservation of citizens in reserve (maintained in military commissariats) and are communicated to company managers.

For failure to submit fixed time a fine in the amount of 300 to 1000 rubles is imposed on the military commissariat or other body carrying out military registration of lists of workers subject to initial military registration. For failure to notify an employee of a summons from the military commissariat and failure to ensure timely attendance at the summons, a fine of 500 to 1000 rubles is provided. (Article 21.2 of the Code of Administrative Offenses of the Russian Federation).

Late submission of information about changes in the composition of permanently residing citizens or citizens staying for more than three months in a place of temporary residence, who are or are required to be registered with the military, is punishable by a fine in the amount of 300 to 1000 rubles. The person responsible for military registration work notifies employees about calls to the military commissariat, ensures that they are able to appear on time, and also, at least once a year, checks the information about the military registration of citizens in personal cards with the military registration documents of military commissariats or with the registration data of a local government body .   • Order “On the organization of military registration of citizens, including the reservation of citizens in reserve.” It determines the composition and functions of employees for maintaining records and booking citizens. Document flow for military accounting work (VUR)

Registration of reservists and potential recruits is carried out according to the established model - personal card T-2 section 2 or civil servant card form T-2GS.

In case of VUR, the company provides the following documents to the VC:

  • data on accepted/dismissed citizens who are or are required to be registered with the military ( further – accounting) – information is transmitted within a 2-week period;
  • annually no later than November 1 - lists of men aged 15-16 years;
  • list of men who will turn 17 next year.

When filling out an employee’s personal card (according to Form No. T-2), it is required to provide a military ID or a temporary certificate in exchange for a ticket if the citizen is in the reserves. Registration of an organization for military registration

Those companies that have not previously kept records of employees, including external part-time workers, must necessarily go through the registration procedure with VK. Methodological materials, forms and induction training are carried out by the staff of the commissariat.

In company branches, reservations and accounting in VK are carried out at the location of the unit. If this is not possible, the data is sent via communications from the organization's head office.

Responsibility for military registration in the organization

  • the responsibility for accounting is assigned to 1 employee (part-time with the main activity), if less than 500 people are registered;
  • when the number of people liable for military service is up to 2 thousand, the specialist is responsible for accounting as the main load;
  • 2 employees – the number of people liable for military service is from 2 to 4 thousand people;
  • for every 3 thousand potential employees, 1 employee of the organization is involved in accounting obligations.

Candidates applying for record keeping must be approved by the VC, which will avoid problems and disputes later.

Instructions for maintaining military records in organizations

The organization of registration of potential military personnel for the period of hostilities in the organization should not go against the standards and legislative acts. Stage 1 – order to organize accounting at the enterprise according to the model (Appendix 4 to the Method Recommendations). This document should cover the following information:

  • full name of the organization;

  • responsible person;
  • deputy responsible employee during vacation/incapacity;

A copy of the order with the seal and signature of the head of the company must be transferred to the military registration and enlistment office.

Stage 2 – the work plan is agreed with the VC. A sample plan for recording those liable for military service in an institution/organization can be found in Appendix 17 of the MP. The document contains the following information:

  • action plan;
  • implementation deadlines;
  • name of company;
  • a note confirming the approval of documentation with VK.

Stage 3 – journal of reservations and checks of citizens. A sample document is presented in the Method Recommendations, and can also be taken from experienced lawyers (as of the current date in accordance with the legislation of the Russian Federation and new regulations). Such a regulatory legal act is drawn up in the form of a table with columns:

  • date of inspection;
  • Full name/position of the authorized/responsible person according to the order;

Stage 4 – checking the authenticity of documents of employed citizens. Employees must submit a military ID card to the Human Resources Department on the form established on the date of receipt. Employees who have not served in the RA present a registration certificate. In both cases, photos, seals, signatures and information in a military document and passport should not have double meaning or any controversial issues.

Stage 5 – personal cards of employees must be filled out according to the established sample and form. What should be included in the document:

  • Family status;
  • education;
  • place of work/service;
  • job title;
  • residence/registration address.

Stage 6 – explanatory conversation with employees on their rights and responsibilities for military registration and training.

Personal cards are stored in a file cabinet with an alphabetical and other system convenient for the company.

Military registration documents

What documents are the basis for military registration/non-registration and the formation of a citizen’s personal card:

  • citizen's certificate of the established format - cover with the coat of arms of the Russian Federation and an inscription;
  • The military ID has a green cover, a coat of arms and the title - “Russian Federation. Military ID of a reserve officer." An exception is documents before 1994 and 2000, which were issued with the stamp of the USSR and the corresponding inscription;
  • a certificate in lieu of a military ID is issued solely for the purpose of identifying a citizen liable for military service who, due to circumstances, has not received a military ID. The certificate must have an official stamp and the seal of the Military Commissariat, which is best checked by sending a request to the military registration and enlistment office;
  • A temporary certificate is issued for a period of up to 30 days with subsequent extension, in the absence of complete information for registration of a person liable for military service in the prescribed form.

Who is not registered for military service?

Not all employees in 2018 appear in the organization’s accounting documents. According to the legislation of the Russian Federation, not all employees are placed under control by the military registration and enlistment office. An exception:

  • previously exempted from military duty for health reasons and other reasons;
  • served in another state;
  • citizens undergoing military or civilian (alternative) service;
  • permanently residing in another state;
  • reserve officers of the Russian Foreign Intelligence Service and the FSB;
  • women without a military specialty.
In case of violation of military registration, deliberate exclusion of a number of employees, submission of distorted information to the Military Commission and other violations, liability is provided in accordance with the Code of Administrative Offenses of the Russian Federation.

Responsibility for violation of the military registration procedure

Companies that deliberately deviate from providing information on conscripted employees to the military registration and enlistment office, as well as those that do not have an accounting department, are subject to administrative penalties in the form of fines. What punishment is provided in 2018:

  • fine from 300 to 1 thousand rubles. for late submission of lists of citizens to the VK - sanctions are applied to the head of the company or the responsible person;

Verification of the formation of documents for employees liable for military service in organizations is carried out by local government bodies and the Military Commission.

Who maintains military records and reservations in the organization?

Checking military records in organizations

Monitoring of accounting in large organizations (with more than 500 employees) is carried out once a year. The check is carried out by representatives of the military registration and enlistment office or local government bodies. If the number of employees in a company is less than 500 people, inspection can be expected once every 3 years.

Inspectors evaluate the reliability of the organization’s documents related to record keeping: personal cards of employees, work plan for record keeping. The results of the inspection are recorded in a special journal.

Regulatory guidelines

When applying for a job, some categories of citizens are required to provide a military ID to the personnel department. According to Article 65 Labor Code, this document is presented by applicants liable for military service and persons subject to conscription into the army.

Regulations on maintaining military records were developed and approved by the Russian Government (Resolution No. 719 of November 27, 2006). It states, in particular, that the head of the company is responsible for the correct organization of accounting activities (clause 9). Their provisions largely repeat the content of Government Resolution No. 719, but they also contain additional information. Military registration in an organization: step-by-step instructions 2018

This accounting activity is divided into several stages. The features of each organizational stage should be described separately.

Stage 1 – identification of responsible persons

Who in the organization will deal with military registration is determined by its head. He has the right to provide for staffing table special personnel units to which employees will be hired for record keeping.

If management intends to release one of the existing employees for accounting activities (for example, on a part-time basis or transfer), it issues an order on the organization of military registration, which lists the employees assigned to conduct it.

  • subordinates liable for military service (age does not matter).

The last category includes employees who are in reserve. In particular, women who have acquired a military specialty (for example, trained as a military paramedic), as well as persons:

  • have completed alternative service;
  • legally exempt from conscription;
  • enlisted in the reserves after leaving military service;
  • those who have successfully completed their studies at the military department, etc.

The full list of employees liable for military service is presented in paragraph 12 of the Methodological Recommendations of the General Staff dated July 11, 2017.

Stage 3 – registration of personal cards

In order to properly maintain military records in an organization, the instructions require accepting certain documents from employees:

  • conscripts present a certificate confirming their status;
  • Those liable for military service present their military ID.

Based on them, the responsible employee creates personal cards for the “accounting” employees.

Stage 4 – development and maintenance of accounting documentation

Methodological recommendations of the General Staff oblige enterprises to maintain a voluminous package of documents on military registration. In particular, in addition to personal cards, an organization needs to have:

  • accounting work plan;
  • audit log;
  • templates for receipts for receiving military documents.

The entire list of required documentation is presented in paragraph 39 of the Recommendations.

Stage 5 – regular implementation of measures for military registration of employees

This stage covers a complex of various activities that are the responsibilities of employees responsible for military registration. They are named in several paragraphs of Government Decree No. 719: 30, 31, 32. In general, accounting measures can be divided into 3 types:

  • to ensure correct military registration;
  • on maintaining personal cards;
  • on updating information about registered employees.

For violation of the requirements for maintaining military records, the responsible person may be fined 300-1000 rubles (Article 21.1-21.4 of the Administrative Code).

“On Defense” clearly and unambiguously stipulates the obligation of organizations and officials to maintain military records in the organization. Article 8 “Functions of organizations and responsibilities of their officials in the field of defense” of the above law states that “organizations, regardless of their form of ownership, in accordance with the legislation of the Russian Federation, carry out military registration of employees and, in accordance with the legislation of the Russian Federation, provide buildings and structures for defense needs , vehicles and other property in their ownership, with subsequent compensation for expenses incurred in the manner established by the Government of the Russian Federation.” The same article states that “ officials organizations regardless of their form of ownership:

1) must fulfill their duties in the field of defense provided for by the legislation of the Russian Federation;

2) create for employees the necessary conditions for the performance of their military duties in accordance with the legislation of the Russian Federation.”

Thus, the most common mistake employers make regarding military records is that many organizations do not keep them. Some believe that if they are not government-owned, budgetary organizations, then they are not obliged to do this, others do not find the resources for this (for example, they may need additional workers in the HR department). However, the legislation directly provides for the employer’s obligation to maintain military records.

On a note! Any employer is obliged to keep military records in the organization; there is not a single legal excuse for not keeping military records (even if there are no military personnel in the organization at all)!

How to properly maintain military records in an organization is prescribed in the Methodological Recommendations for maintaining military records in organizations (approved by the General Staff of the Armed Forces of the Russian Federation on April 11, 2008).

Who is subject to military registration?

The following are subject to military registration in organizations (clause 14 of the Regulations on military registration, approved by Decree of the Government of the Russian Federation of November 27, 2006 No. 719):

1) male citizens aged 18 to 27 years who are required to be registered with the military and are not in the reserves;

2) citizens who are in reserve. The categories of citizens who are in reserve are established in paragraph 1 of Art. 52 Federal Law dated March 28, 1998 No. 53-FZ.

The following citizens are not subject to military registration in military commissariats, local self-government bodies and organizations (clause 15 of the Regulations on Military Registration):

1) exempted from military duty in accordance with Art. 23 of the Law on Military Duty;

2) undergoing military service;

3) those serving a sentence of imprisonment;

4) female, without a military specialty;

5) permanently residing outside the Russian Federation;

6) having military ranks officers and reserve personnel of the Foreign Intelligence Service of the Russian Federation and the Federal Security Service of the Russian Federation.

Military registration of those liable for military service is divided into special and general (clause 16 of the Regulations on military registration).

Persons liable for military service who are subject to special military registration are in the prescribed manner are reserved for state authorities, local government bodies or organizations for periods of mobilization, martial law and in wartime, as well as those serving in internal affairs bodies, the State Fire Service, institutions and bodies of the penal system, drug control agencies and psychotropic substances in positions of ordinary and commanding personnel.

The rest of those liable for military service are on the general military register.

What documents should a military registration organization have?

1) an order on the organization of military registration of citizens, including the reservation of citizens in reserve.

2) a work plan for maintaining military records of citizens and booking citizens in reserve. The specified plan in order to ensure the completeness and quality of military registration of conscripts and those liable for military service from among those working (studying) in organizations ( educational institutions) and reservations for citizens staying in reserve, organizations develop during the calendar year. The plan must be agreed upon with the military commissariat of the municipality.

3) a file cabinet of personal cards of form No. T-2 and No. T-2 GS (MS) for citizens from among conscripts and citizens in reserve;

4) a log of checks on the implementation of military registration and reservation of citizens in the reserves of the Armed Forces of the Russian Federation;

5) receipts for receiving military registration documents from citizens (the form of receipt is established by Appendix No. 14 to the Methodological Recommendations).

6) official paperwork (a separate matter) on the issues of maintaining military records of citizens and booking citizens in the reserve in the organization;

7) other documents in accordance with the requirements established by federal executive authorities, executive authorities of constituent entities of the Russian Federation, local government bodies and heads of organizations;

8) background information on military registration, mobilization preparation and mobilization.

Special attention deserve documents that must be regularly submitted to the military registration and enlistment office!

Typical mistakes in military registration.

1. The organization does not require military registration documents from the employee;

2. The organization makes mistakes when maintaining a personal card for military registration;

3. The organization does not agree with the military registration and enlistment office on the work plan for the implementation of military registration and the order on the organization of military registration;

4. The organization does not send information about the hiring/dismissal of employees to the military registration and enlistment office;

5. The organization does not verify information with the military registration and enlistment office;

6. The organization lacks information/local regulations on military registration.

Violations by employers in the field of military registration are associated with insignificant liability. The only norm that provides for liability for deficiencies in military registration is Art. 21.4 Code of Administrative Offenses of the Russian Federation. For failure by the manager or other responsible person to report to the military commissariat information about those hired or dismissed from work of citizens liable for military service under Part 3 of Art. 21.4 of the Code of Administrative Offenses of the Russian Federation, the fine ranges from 300 to 1000 rubles. Organizations do not take such a fine seriously. Therefore, they prefer not to keep military records at all or to keep them partially.

However, when the organization receives a request from the military registration and enlistment office to submit documents, military records will have to be maintained. If the requirements of the military registration and enlistment office to submit documents in accordance with the law are ignored, penalties will follow:

- fine from 2000 to 4000 rubles. against officials for disobedience to a lawful order or requirement of an official of a body exercising state supervision (control) (Article 19.4 of the Code of Administrative Offenses of the Russian Federation);

- a fine from 3000 to 5000 per company and from 300 to 500 rubles. against officials for failure to submit or untimely submission of government agency information (information), the presentation of which is provided for by law (Article 19.7 of the Code of Administrative Offenses of the Russian Federation);

- a fine of 10,000 to 20,000 per company and from 1,000 to 2,000 rubles. or disqualification for up to three years for officials for failure to comply within the prescribed period with a legal order of the body exercising state supervision.

Thus, in the case of requests from the military registration and enlistment office and when reporting an inspection by the military registration and enlistment office of military registration, the risk from insignificant becomes quite noticeable.

For managers educational organizations Also relevant is the issue of the failure of the head or other official of the organization, as well as the official of the local government body responsible for military registration work, to submit lists of citizens within the prescribed period to the military commissariat or other body carrying out military registration, subject to initial statement for military registration, entails the imposition of an administrative fine in the amount of 300 to 1000 rubles.
