Log of pre-trip medical examination of drivers in 2018 - 2019: basic content requirements

The results of the pre-trip medical examinations are mandatory recorded in a special journal (hereinafter referred to as the journal), in accordance with paragraph 14 of the “Procedure ...”, approved. by order of the Ministry of Health of Russia dated December 15, 2014 No. 835n (hereinafter - order No. 835n).

In this case, the following data should be entered in the named log:

• date and time of the medical examination;
• surname, name, patronymic of the driver;
• driver's gender and date of birth;
• the results of a medical examination (fixing complaints, signs of intoxication, etc.);
• conclusion of a medical officer based on the results of a medical examination.

Also, in the corresponding columns of the journal, the signatures of the medical officer conducting the examination (with a transcript) and the driver being examined are affixed.

The need to keep a journal with the fixation of the named information in it is fixed, among other things, by the letter of the Ministry of Health of the Russian Federation of August 21, 2003 No. 2510 / 9468-03-32.

Clause 15 of order No. 835n establishes that the journal can be kept on the following types of media:

• on paper - in this case, the document must be laced, and its sheets must be numbered; the firmware should be sealed with the seal of the organization;
• on electronic - while the data recorded in the journal must be protected by enhanced qualified electronic signature; it should also be technically possible to print any page of the magazine in case of such a need.

How long should the driver's pre-trip medical examination log be kept?

"List ...", approved. by order of the Ministry of Culture of Russia dated August 25, 2010 No. 558 (hereinafter - Order No. 558), does not contain a direct indication of how long the organization is obliged to keep such a journal.

However, taking into account the practical purpose of the document, many lawyers are inclined to believe that it should be kept in the organization for 5 years (see paragraphs 646-647 of order No. 558), since it rather belongs to the section “Labor protection » of the specified list.

Along with this, there is another opinion, when the period of storage of the journal is determined as 3 years in accordance with paragraph 914 of order No. 558 (section "Social insurance").

With regard to documents stored in digital form, the provisions of clause 2.30 of the order of the Ministry of Culture of the Russian Federation of March 31, 2015 No. 526 should also be observed.

So, the journal can be kept in any form, although Order No. 555 recommends an option that takes into account the possibility of entering all the information required by the regulations following the results of a medical examination. The journal can be stored both on paper and on electronic media.
