From January 1, 2019, a new federal minimum wage was established in Russia – 11,280 rubles. How to use it? Who should raise their salary and complete the paperwork correctly? What minimum wages will be established in the regions from January 1, 2019? We will answer the questions and provide a table with the minimum wage by region as of January 1, 2019.

New federal minimum wage from 2019: new amount

According to Article 1 of the law on minimum wages (dated June 19, 2000 No. 82-FZ), from January 1, 2019, the minimum wage is fixed by federal law in the amount living wage working population in Russia as a whole for the second quarter of the previous year.

By order of the Ministry of Labor and social protection Russian Federation dated August 24, 2018 No. 550n determined the living wage in Russia as a whole for the second quarter of 2018. The order sets the cost of living for the second quarter of 2018 on average per capita at 10,444 rubles. Living wage:

  • for the working population is determined in the amount of 11,280 rubles;
  • for pensioners – 8,583 rubles;
  • for children – 10,390 rubles.

This means that in 2019 the minimum wage for the working population will be 11,280 rubles.

Note that from May 1, 2018, the minimum wage was 11,163 rubles per month. It turns out that from January 1, 2019 it will increase by only 1%. (up to RUB 11,280). Only 117 rubles.

Regional minimum wages cannot be less than 11,280 rubles

Minimum wage values ​​are fixed at the federal and regional levels. As we have already said, at the federal level in Russia the minimum wage from January 1, 2019 is 11,280 rubles.

However, each region must also have its own minimum wage. It is established by the constituent entities of the Russian Federation through regional agreements on the minimum wage. The regional minimum wage is usually higher than the federal one. But it cannot be less! (Article 133.1 of the Labor Code).

Organizations must set wages no less than the regional minimum wage if they have joined regional agreements. “By default”, those employers who, within 30 calendar days after the official publication of the agreement, have not sent a written reasoned refusal to join to the labor authority of a constituent entity of the Russian Federation, join the regional agreement. If such a refusal occurred, then compare salaries with the federal minimum wage. If the refusal was not sent, rely on the regional minimum wage (Part 8 of Article 133.1 of the Labor Code).

If in the constituent entity of the Russian Federation in which the employer operates, a special agreement has established the size of the regional minimum wage, then the salary of employees should not be less than this amount (Article 133.1 of the Labor Code of the Russian Federation). However, if the employer does not want to join this agreement, then he has the right to issue a written refusal to join. Those who did not write such a refusal are considered to have automatically joined the regional agreement. Consequently, if they pay wages below the regional minimum wage, these employers face the same sanctions as if they pay wages below the federal minimum wage.

When can a salary be less than the minimum wage?

Sometimes the salary may be less than the minimum wage after January 1, 2019, since the salary includes not only the salary itself, but also compensation payments (for example, various allowances for working conditions), as well as incentive payments (for example, bonuses) (Art. 129 of the Labor Code of the Russian Federation). Therefore, if in a month an employee receives, taking into account all allowances and incentives, an amount greater than or equal to the minimum wage, then this is quite normal.

If, after deducting personal income tax, from the income due to the employee, he receives an amount less than the minimum wage (RUB 11,280), then this is normal.

Keep in mind: allowances for working in the Far North and regional coefficient do not include in the salary amount that you compare with the minimum wage. Accrue these payments on top of your salary. That is, the salary should be no less than the regional or sectoral minimum wage, without the regional coefficient and the “northern bonus”.

How to properly increase wages to the new minimum wage in the regions

If an employee’s salary for full working hours is less than the new minimum wage or the regional or industry minimum, then it must be increased from January 1, 2019. Here are the options:

Option No. 1: salary increase

This option is not very convenient. After all, every time the minimum wage changes, you will have to issue not only an order to increase wages, but also change employment contracts, staffing table and other documents that mention the size of salaries. Option number 2: additional payment

Establish a special surcharge in a local act, for example, in a separate order or regulation on wages. After all, it is not the salary that is compared with the minimum wage, but the total salary. That is, salary plus bonuses and other benefits.

This method is easier. There is no need to edit employment contracts and other local acts every time the minimum wage changes. It is enough to establish a compensatory additional payment up to the minimum wage once, for example, in the regulations on wages.

Minimum wage in Russia in 2019

From January 1, 2019, the minimum wage is equal to the subsistence level for the working-age population for the 2nd quarter of last year. This follows from Law No. 421-FZ. The Order of the Ministry of Labor dated August 24, 2018 No. 550n on establishing the subsistence level for the 2nd quarter states that the subsistence level for the working population for the 2nd quarter of 18 is 11,280 rubles. Therefore, the federal minimum wage from January 1, 2019 is equal to 11,280 rubles.

Starting with the salary for January 2019, the employer will not be able to pay an employee who has worked the monthly standard working hours a salary below 11,280 rubles.

Earlier, some media reported that the minimum wage would not increase in 2019. The Ministry of Labor officially stated on its website that - quote: “these messages are not correct.”

As the Ministry of Labor explained, the legislation provides for a mechanism for the annual establishment of the minimum wage in an amount equal to 100% of the subsistence level of the working population as a whole in the Russian Federation for the second quarter of the previous year.

Many Russians are interested in the upcoming increases promised by the government in 2019: this includes an increase in salaries for public sector workers, indexation of pensions and other official payments, and, in fact, an increase in the minimum wage - the minimum wage. That is, as we can understand, the employer does not have the right to pay the employee less than the established limit.

Next year, they decided to raise the minimum wage to the level of the subsistence minimum, and it will be equal to 11 thousand 280 rubles. This amount will fully correspond to the cost of living for the working population, based on calculations for the second quarter of 2018. Thanks to the increase in the minimum wage in Russia, the wages of about 3.7 million workers will be increased, but, unfortunately, they will not increase as much as Russians would like.

When will the next increase in the minimum wage in Russia take place?

The next increase will take place on January 1, 2019. It is from this date that the new minimum wage will come into effect, although it will be approved much earlier. The minimum wage will increase by 117 rubles.

Initially, a more significant increase was planned on January 1, but in connection with the elections and Putin’s pre-election promises, on May 1 the first stage of increasing the minimum wage took place, which became equal to the subsistence level. However, all this is only in words, because for survival and life a much more significant amount is needed than what we have now (11,163 rubles).

To what level will the minimum wage be increased from January 1, 2019?

Previously, the increase in the minimum wage was indexed by calculating last year's inflation rate, but now this indicator directly depends on the required subsistence level. This is logical, because all social payments are taken based on the cost of living indicator. Data on expenses appear during the first half of the year, and in the second, everything is calculated and officially approved by the government.

Although the minimum wage level for next year has not yet been officially approved, it has already been calculated and with almost 100% probability we can say that it will increase by 117 rubles and will be equal to 11,280 rubles. This good growth in comparison with the indicators of 2017, when the minimum wage was in the region of 7-8 thousand.

On March 7, 2018, the president signed a law increasing the minimum wage from May 1 to 11,163 rubles. The head of the country fulfilled his recent promise and equalized the minimum wage to the subsistence level; now, when calculating child benefits and sick leave, it will be necessary to start from the new amount. The new minimum wage will not affect the level of salaries of most workers in any way, unless they received less than the minimum wage.

In September 2017, the Ministry of Labor announced a bill to gradually increase the minimum wage and bring it to the subsistence level. The project was signed by the president and came into force on January 1, 2018. What is the minimum wage and living wage

Minimum wage is the minimum wage below which the employer has no right to pay the employee. The only exceptions are those who work part-time or part-time. The living wage is the cost of the minimum necessary set of products and goods that are needed to maintain human life. The minimum wage affects the size, so its increase will have a positive effect on these payments.

What does increasing the minimum wage give?

For pensioners increasing the minimum wage will not play a significant role. The labor pension is calculated based on the individual pension coefficient, length of service, disability group, and the presence of dependents.

The minimum wage can only affect the size of the state pension, which is paid to citizens based on their average monthly earnings, total length of work experience, and category of recipient. This pension is paid to a narrow group of people:

  • civil servants;
  • military personnel;
  • WWII participants;
  • astronauts;
  • victims of man-made disasters.

For state employees An increase in the minimum wage means an increase in wages if previously they received payment below the newly established amount. Those workers whose wages are higher than the minimum wage will not be affected by the changes, and their wages will not be indexed in any way.

If an employer pays wages less than the minimum wage for a full day of work, the state fines him. If an employer pays wages below the established norm for at least 2 months, then he faces criminal liability.

The minimum wage does not affect the amount of social payments disabled people, since their benefits are calculated based on the cost of living in the region.

Putin on increasing the minimum wage from May 1, 2018

During a meeting with the management and workers of the Tver Carriage Plant, the president discussed a number of issues that interested them. One of the workers asked how soon the minimum wage and the subsistence level are expected to be equalized, to which the president replied that this problem is relevant and indeed in the country about 4-5 million workers receive wages below the subsistence level, which is simply unacceptable for a civilized state.

From the moment the presidential order was issued, the regions have 30 days to decide which minimum wage level they will follow: federal or regional. Within the allotted time, they must send an official refusal of the regional minimum wage if they want salaries and benefits to be calculated based on the federal value.

If the minimum wage in a region is higher than the federal one, then wages should be paid based on this value, and not the federal “minimum wage”.

How does the minimum wage affect individual entrepreneurs?

Since January 1, 2018, individual entrepreneurs no longer need to monitor the minimum wage level; now they insurance premiums fixed and do not depend on the minimum wage.
