What is a professional standard?

The concepts of “employee qualification” and “professional standard” are defined in Art. 195.1 Labor Code Russian Federation. According to this article employee qualifications- this is the level of knowledge, skills, professional skills and experience of the employee.

From the history of professional standards in Russia

The emergence of professional standards is not a new thing, invented in Russia, as many write, but an established world practice. The most advanced experience today in terms of professional standards is in the UK.

In 2010, following a meeting of the State Council of the Russian Federation and the Commission for Modernization and Technological Development of the Russian Economy, a list of instructions of the President of the Russian Federation was created. It established the deadlines for the preparation of a modern reference book and the development of professional standards in high-tech industries. About two years were allotted to complete both tasks.

In 2011, the Government of the Russian Federation established the Agency for Strategic Initiatives (ASI), which began developing a roadmap for “Creating a National System of Qualifications and Competencies.” After this, the Plan for the Development of Professional Standards for 2012-2015 was approved. Experts from the Ministry of Labor prepared and approved the next layout of the professional standard and developed regulations, methodological recommendations, etc. The first standards were adopted only on October 30, 2013. By Decree of the President of the Russian Federation dated May 7, 2012 No. 597 “On measures for the implementation of state social policy,” the Government of the Russian Federation was given the task of developing and approving at least 800 professional standards by 2015. “As of December 30, 2014, 403 professional standards were approved by orders of the Ministry of Labor,” says a message posted on January 24, 2015 on the website of the Government of the Russian Federation.

Thus, in accordance with Part 4 of Article 7 of Federal Law No. 402 of December 6, 2011, in insurance companies, non-state pension funds, public JSC, the chief accountant must have:

Based on the professional standard of the Russian Federation, the employer has the right to approve new job descriptions. Qualification requirements for specialists in various industries

For an accountant of a budgetary institution:

  1. The minimum requirement is secondary specialized education.
  2. Work experience - at least 3 years for a simple accountant, at least 7 years for a chief accountant, including 5 years in the relevant field.

For the head of an educational institution:

  1. Prior to appointment, work in a teaching or management position for at least 3 years.

For the head nurse:

  1. Secondary specialized or higher education in nursing.

If the answer to this question is negative, the employee can be offered two options - send him for training or transfer him to another position that corresponds to the level of his knowledge, experience and education. Why are professional standards needed?

A professional standard is the name of an important fundamental document that contains a description of the following standards:

Thus, we can say that professional standards include a description of the qualitative level of qualifications of an employee, which he must meet in order to rightfully take his place on the staff of any company, regardless of the type of its activity (Article 195.1 of the Labor Code of the Russian Federation).

Professional standards and their scope of use

These standards may be applied and taken into account for the following purposes:

  • to organize training and certification of employees;
  • policy formation when staffing an enterprise with highly qualified personnel;
  • organization of management processes;
  • establishing internal tariffs for work performed;
  • facilitating the classification of tariff categories;
  • developing your own systems for paying working hours, taking into account the specifics of work at a particular enterprise.

Are professional standards mandatory for implementation or are they only intended to facilitate the organization of an enterprise and production? Should the employer (company owner) unquestioningly follow them, accepting step by step instructions? Or does he have the right to choose the area and order of their application? Mandatory application of standards

Paragraph three of part 2 of Article 57 of the Labor Code of the Russian Federation talks about the mandatory nature of professional standards. In particular, this provision mentions such important document like an employment contract. Thus, if the receipt by an employee of an enterprise of special benefits, compensation or restrictions is directly related to the performance of duties inherent in a particular position, then the employer is obliged to be guided by reference books on qualifications or state professional standards.

EXAMPLE

Citizen "P" by nature of service is involved in particularly harmful and difficult work. A benefit and compensation for citizens engaged in such activities is early retirement. This means that after leaving for a well-deserved rest, an employee can count on receiving the benefits due to him, his position must be spelled out in the employment contract exactly as it is listed in the directory or professional standard. Therefore, it is very important to take into account such nuances and correctly compose and fill out all necessary documentation. If a mistake is made and this comes to light (for example, at the request of the employee himself or as a result of an ongoing audit of the enterprise), then the company’s management may be held accountable.

The Administrative Code in the 4th part of Article 5.27 provides for punishment for such criminal negligence - a large fine. Its size may vary:

  • from 50 to 100,000 rubles – for an organization;
  • from 10 to 20,000 – for officials;
  • from 5 to 10,000 – for private entrepreneurs.

Which, however, does not relieve the former or current employee from subsequent problems with receiving all the benefits and compensation due to him for the past period.

Requirements for employees to comply with professional standards

Article 195.3 of the Labor Code of the Russian Federation regulates the use of professional standards by employers. It provides a brief but succinct definition of an employee’s qualifications. And it is explained that if the requirements for the qualifications of a worker are legally defined, then the application of the standards becomes the indisputable responsibility of the employer, and not his right.

To make it clearer, let’s look at this point using the example of the professional standard for accountants in 2019. So, in accordance with Part 4 of Article 7 of the Federal Law of December 6, 2011 No. 402-FZ “On Accounting,” the chief accountant who came to get a job (for example, in an OJSC or an insurance organization) must meet the following requirements:

  1. Higher education.
  2. Work experience in the specialty "Accounting" or "Audit" - at least 3 years out of the last five.

But is it necessary to present these requirements if an accountant gets a job in a regular LLC? What if the potential chief accountant does not have a higher education, but has valuable experience and a good track record? Let's look at the professional standard "Accountant". It follows from this that a person can be hired as an accountant with both higher and secondary education.

Therefore, we believe that higher education is mandatory for an accountant only if he plans to work in organizations included in the list given in Part 4 of Article 7 of Law No. 402-FZ (for example, in an OJSC). If not, then it will be enough to have secondary education and work experience, which are prescribed in the professional standard.

Improvement of employee qualifications

The employer has the right to send employees of his enterprise to retraining and advanced training courses. In accordance with Article 196 of the Labor Code, this is his right, but not his obligation. That is, he can make this decision at his own discretion, based on considerations of the feasibility of such training. Most often - to raise the company’s status in the market, its prestige and the qualifications of workers involved in work processes.

In serious and large companies the employer and owner of the company are interested in a high level of training of employees. To verify and confirm it, international professional standards of internal auditing can be used.

Controversial point: is it necessary to study?

There are still disputes and different opinions regarding the above provisions. Some experts refer to Article 195.3 of the Labor Code (its first part), others to the same article in its second part, finding in them some discrepancies and inaccuracies that allow for a double interpretation of their meaning.

As a result, some believe that it is mandatory to apply professional standards, while others believe that they are only advisory in nature. However, both of them agree that if mandatory requirements for the qualifications of employees in a certain specialty are not established by law, then they can only be advisory in nature for the employer and nothing more. Moreover, the latter has the right to use them at his own discretion, setting more stringent or, conversely, softer requirements for employees than required by the standard.

The workers themselves also react ambiguously to professional standards. Many of them express fears that the education they received at various courses will be only formal in nature. And this was invented by legislators for only one purpose – to once again empty their wallets. After all, at the moment there is no clear definition in the law of who will pay for all this.

Let's assume that current legislature does not impose strict requirements on the qualifications of specialists in certain professions. Let, in our case, for clarity, it be “HR Specialist”. Therefore, the professional standards for personnel officers approved for 2019 can be applied to this position. But use them only by taking them as a basis to facilitate the preparation of documentation.

For example, taking the professional standard as a certain template, you can:

  • set reasonable requirements for their qualifications, experience, and education.

Questions of application of Art. 195.3 Labor Code of the Russian Federation

All discrepancies and interpretations of Article 195.3 of the Labor Code of the Russian Federation are associated with its relative novelty. A lot of questions arise regarding the scope of its application. Moreover, it is still not installed:

This does not mean at all that there is no shortage of valuable personnel. Not always new employee with a higher education can replace an old one with only a secondary education behind him professional education, but with enormous experience.

Strict adherence to professional standards

Answer: Yes. The employer must keep in mind that he is obliged to strictly follow the requirements when hiring a person if we are talking about issues regulated by Articles 57 part 2 and 195.3 of the Labor Code of the Russian Federation. Based on Art. 195.3 of the Labor Code of the Russian Federation and in connection with the need to develop a Plan for organizing the application of professional standards, provided for by Decree of the Government of the Russian Federation of June 27, 2016 No. 584,

I ORDER:

1. Create a Commission for organizing the application of professional standards, composed in accordance with Appendix 1.

2. Approve:

2.1. Regulations on the Commission for organizing the application of professional standards (hereinafter referred to as the Commission) in accordance with Appendix 2.

2.2. Regulations of the Commission according to Appendix 3.

3. Before (indication of date) the Commission shall develop a draft Plan for organizing the application of professional standards (hereinafter referred to as the Draft), which shall be sent to structural units within three calendar days.

4. For managers structural divisions within five calendar days, review the Draft and, if there are comments and suggestions, submit them to the Secretary of the Commission.

5. The Commission will study comments and suggestions to the Project and no later than (date) agree on the Project in in the prescribed manner.

6. To the HR service (or HR specialist) submit the Project to the manager for signing and, within three calendar days after signing, familiarize the members of the Commission with the order for signature.

7. Control over the execution of the order remains with (the position, as a rule, of the manager).

1. General Provisions.

1.1. The working group on the implementation of professional standards is a consultative and advisory body created to assist in the phased implementation of professional standards in ________________________________.

1.2. A working group is created in the organization for the period of implementation of professional standards.

1.3. In its activities, the working group is guided by the Constitution of the Russian Federation, the Labor Code, by-laws regarding the approval and implementation of professional standards, as well as these Regulations.

2. The main tasks of the working group.

2.1. The main tasks of the working group are:

Identification of professions and positions for which the use of professional standards is mandatory (compilation of generalized information on this issue);

Preparation of proposals for amendments and additions to local regulations legal acts organizations on issues related to ensuring the introduction and implementation of the requirements of professional standards;

Preliminary consideration of draft local acts on the implementation of professional standards;

Preliminary assessment of the compliance of the level of education of employees with the requirements of professional standards based on the analysis of educational documents, including advanced training and (or) retraining, provided by the employee, both when hiring and during the employment relationship;

Preparation of recommendations for changing the remuneration system in order to improve it and establish wages depending both on the qualifications of the employee and on the actual results of his professional activities (performance criteria).

2.2. The working group to carry out its tasks:

Analyzes work to resolve issues of organizing the implementation of professional standards;

Consults responsible employees institutions entrusted with the responsibility for implementing professional standards, on the problem of introducing and implementing professional standards in order to increase the level of their competence;

Listens to information regularly personnel service, heads of departments on the progress of implementing professional standards;

Informs employees about preparation for implementation and the procedure for transition to professional standards through visual information, the official website of the organization, holding meetings, individual consultations, written responses to requests from individual employees;

Prepares reference materials on the introduction and implementation of professional standards, prepares proposals for holding seminars, including participation in seminars on the implementation of professional standards.

3. Composition of the working group.

3.1. The working group is created from among the competent and qualified employees of the organization. The working group must include the head of the organization, a representative of the trade union organization and a personnel service employee.

3.2. The quantitative and roster composition of the working group is determined by order of the director. Changes to the order are made as necessary.

4. Procedure for the working group.

4.1. Meetings of the working group are held as necessary, but at least ______.

4.2. Meetings of the working group are open.

4.3. A meeting of the working group is valid if at least 2/3 of the working group’s roster is present.

4.4. The agenda of the meeting is formed by the head of the working group based on proposals from members of the working group and is approved at the meeting of the working group.

4.5. Decisions of the working group are made by a simple majority of votes and documented in a protocol signed by the chairman of the working group.

4.7. The activities of the working group are terminated (suspended) and resumed by order of the leader.

4.8. The working group on the implementation of professional standards does not replace other commissions (working groups) created in _____ (certification, qualification), and cannot fulfill the powers assigned to other commissions (working groups).

5. Final provisions.

5.1. This Regulation comes into force from the moment of its approval and is valid until it is cancelled, amended or replaced.

ABOUT THE WORK REGULATIONS OF THE COMMISSION.

The line between regulations and regulations is quite blurred. Of course, these documents differ. But since they are created for internal use, it’s okay if some of the information in the regulations ends up in the regulations and vice versa. The main thing is that it is convenient to work with them. In addition, they can always be corrected.

Regulations are a technical document, a set of interrelated norms that regulate a narrow area of ​​life (in this case, the life of an institution). The norms determine the procedure for forming and ensuring a specific area of ​​activity of the institution. This document establishes the course of action or status official. The situation creates common base for a particular field of activity, outlines the range of issues, designates the procedure.

Regulations- a technical document that fixes a list of rules that are mandatory for use in a particular project, situation, industry, etc. - specifies certain issues. The regulations are a more specific document; they can disclose individual terms of the provision so that there is no double interpretation. The regulations describe an algorithm for specific actions, maximum permissible values, etc. For example, if the regulation states that a working group is created in an organization for the period of implementation of professional standards, then the regulations fix the procedure for creating this group: who is responsible, when the group should be created, how fix its composition, etc. Typically, regulations are created on the basis of a regulation, clarifying the algorithm for performing the tasks included in the regulation.

WE MAKE A PLAN.

The created commission begins work on the plan.

There is no unified sample schedule for implementing the professional standard, so it can be drawn up in free form.

However, there are requirements for the plan - they are listed in Part 1 of Resolution No. 584. The plan for introducing a system of professional standards in an institution must contain:

  • list of professional standards to be applied;
  • information about the need for vocational education, vocational training and (or) additional vocational education of workers, obtained on the basis of an analysis of the qualification requirements contained in professional standards, and staffing institutions, and on carrying out relevant education and training activities in the prescribed manner;
  • a list of local regulations and other documents of the institution, including on issues of attestation, certification and other forms of assessing the qualifications of workers, subject to change taking into account the provisions of professional standards to be applied.

Other points may be included in the plan for the convenience of transition to the system of professional standards. Each employer creates a plan to suit its needs. Some describe all the events in detail. Others are just a transition to specific professional standards.

You can add all activities to the plan as a list - as they are completed. But it is better to divide them into the following blocks:

  • Organizational and legal support and information support.
  • Updating the regulatory framework.
  • Determination of Compliance professional level workers to the requirements of the standard.
  • Development professional competencies. Training.

It is more convenient to arrange the schedule of professional standards in the form of a table with specific tasks, deadlines and responsible persons. When compiling, you can take as a basis both the Development of the Ministry of Education and Science and the Methodological Recommendations of Social Protection.

On July 1, 2016, Art. 195.3 of the Labor Code of the Russian Federation, and the use of professional standards becomes mandatory for employers of all forms of ownership. What is the schedule for the implementation of professional standards in an organization and its sample? How to begin introducing a new approach to the knowledge and experience of employees, who does this concern first?

Application of standard professional standards

A professional standard is a list of requirements for the level of education, knowledge, and experience of a worker in a certain profession. At the moment, more than 800 such documents have been approved. Among them are metallurgical, woodworking, nuclear industries and others. But in addition to representatives of serious industries, there are also teachers, programmers, athletes, accountants and even personnel specialists.

Correct job titles staffing table and used to be very important, especially for those categories of workers who had benefits or restrictions related to work. Compliance with the ECTS or industry directory was the main requirement in this case (Part 2 of Article 57 of the Labor Code of the Russian Federation). A new document - a professional standard, which is developed and approved by the Ministry of Labor of the Russian Federation, should eventually completely replace the ECTS.

Important: the use of professional standards is mandatory in the following cases:

  • In government agencies and enterprises - for all available specialties.
  • In commercial and other organizations - for professions associated with harmful or dangerous working conditions and providing benefits in connection with this.

In practice, the employer must be guided by professional standards both when selecting candidates for work and to determine the level of compliance of its employees with existing requirements. An employee’s failure to meet professional standards is not a reason for his dismissal, but a good reason for increasing his level of qualifications. In accordance with Art. 196 of the Labor Code of the Russian Federation, the need for training is determined by the employer.

How to draw up a schedule for the implementation of professional standards

Drawing up a schedule of professional standards (professional standards) is mandatory for government agencies, we will provide a sample of such a plan below. Commercial organizations must draw it up in relation to positions associated with restrictions on admission or receipt of benefits. For other specialties, professional standards are advisory in nature (Part 2 of Article 195.3 of the Labor Code of the Russian Federation).

First you need to select a working group and determine those responsible. Then draw up a list of activities in the schedule for implementing professional standards, guided by the main objectives:

  • Determine the presence in the staffing table of positions that fall within the existing professional standards. Moreover, the title of the position is not the main thing; the labor function is more important.
  • Check the compliance of the qualifications of your employees with the requirements of the professional standard.
  • Plan employee training if necessary.
  • Determine whether changes need to be made to job descriptions and employment contracts.
  • Compare the names of positions in the organization and professional standards, rename if necessary.
  • Indicate dates for each item in the schedule for the implementation of professional standards.

As you can see, there is a lot of work ahead and it will take a long time. It is better to arrange the schedule of professional standards in the form of a table with specific tasks, deadlines and responsible persons. The document and the composition of the working group must be approved by order of the enterprise.

Important: if there are no professions in your organization in the existing list of approved professional standards, no action needs to be taken until suitable approved professional standards become available. In this case, you need to be guided by the current ECTS or industry directories.

How to fill out a schedule for introducing professional standards in an organization

First you need to determine the goals and objectives of the event. And also assign someone responsible for each stage of work. A sample schedule for the implementation of professional standards should be divided into blocks: preparatory and main activities. These may include:

  • issuance of an order appointing a working group
  • determination of compliance of the qualification level of employees with professional standards
  • drawing up a training plan
  • identification of documents requiring amendments
  • renaming positions if necessary, etc.

Avoidance of implementing the professional standards schedule in cases provided for in Art. 57 Labor Code of the Russian Federation and Art. 195.3 of the Labor Code of the Russian Federation, may result in the issuance of an order to the employer, or even bringing to administrative liability under Art. 5.27 Code of Administrative Offenses of the Russian Federation.
