When choosing a suitable premises, you need to proceed from the concept of the establishment and take into account legal restrictions.

 

When evaluating business ideas, the option of opening a night club for dancing or a themed one more often attracts young entrepreneurs. The interest is understandable: the overwhelming majority of club regulars are people from 18 to 35 years old. On the other hand, for all its profitability, this business requires large investments, characterized by increased risks and complex organization. The success of an enterprise is determined by three main factors:

  • entertainment concept;
  • place and premises for organizing a club;
  • investments to finance the project.

In fact, the first two determine the prospects of a business idea, and the entire subsequent economic calculation: payback period for investments, expenses and income.

The basis of the club concept is the idea

The main “feature” of a nightclub can be anything: unusual architecture of the building, original musical direction, location: floating platform, beach, roof, and so on. According to classification night club- this is the specialization of the establishment according to the interests of consumers (Fig. 1). The document does not provide for such enterprises special conditions, and all general restrictions apply to them in full (Table 2). Let us note the main ones.

  1. Any catering facilities can be located in residential and public buildings(including free-standing ones), on the territory of train stations, shopping centers, offices, cultural and entertainment centers.
  2. Access roads and pedestrian access with information signs must be provided to the enterprise. The surrounding area should be illuminated and landscaped. A restaurant is required to have an equipped parking lot, which cannot be located inside the courtyard area.
  3. If the establishment is located in an apartment building, then all building standards for permissible noise and vibration levels are observed (GOST 30494 - for residential buildings). Separate entrances and exits, including emergency ones, are equipped with instructions on the procedure to act in an emergency.

When placing a club in an ordinary residential building, difficulties arise with transferring the premises to non-residential ones. Housing Code does not require the mandatory consent of all residents (Article 23). However, to develop a separate entrance area, it is often necessary to occupy a plot of land belonging to an apartment building and reconstruct common areas (house wall, entrance). The issue is resolved individually, sometimes you can limit yourself to a solution general meeting(redevelopment), in another situation, the consent of the owners will be required (reconstruction).

When placed in an apartment building, additionally SanPiN 2.1.2.2645-10 applies to living conditions in residential buildings. We list just a few reasons that can lead to fines or even closure of the club.

  1. Food preparation workshops must not be located in basements or semi-basements. Production should not worsen the living conditions of the residents of the house (noise, odors, vibration, electromagnetic fields).
  2. Unloading of products and other raw materials from the entrances of a residential building is not allowed. To do this, a collection point will be installed at the end of the building, where there are no windows, or on the street side.
  3. Garbage and food waste are stored in separate containers on an asphalt (concrete) area no closer than 25 m from the entrance or playground, and are cleaned when 2/3 of the volume is filled.
  4. Exhaust ventilation is equipped separately from the general building ventilation system, 1 m above the roof level. A pipe of this height is attached to the wall of the house, and to use the facade, the consent of the owners’ meeting must be obtained. The issue can be resolved peacefully by concluding a paid lease agreement with the HOA for part of the common property of the house.

Thus, we can conclude. The law does not prohibit the organization of catering establishments, including establishments with night hours, in residential buildings. However, a separate building is more reliable - this will eliminate numerous complaints and inspections.
